A claim of ignorance of the content of the Terms and Conditions does not justify a breach, and any breach will provide the Sellers and the Users to take particular or legal measures that are unaware of what is stated in these Terms and Conditions.
With their registration and / or use of the Platform, the Sellers and the Users are stating that they have read and understood these Terms and Conditions of Use, for which they express their acceptance, and of the same with respect to minors under age who want to use the Platform. All minors must have authorization from their parents or legal representatives prior to registering or ordering services or goods on BUEN DEAL. BUEN DEAL reserves the right to refuse to provide service, close accounts, and delete or edit content at their sole discretion.

"Goods" are the goods, products and / or services that can be offered by Sellers through the Platform and make up the User's Order. The Goods are supplied by the Sellers, who are responsible for them to the Users.
"Seller" refers to external agents and / or third parties outside of BUEN DEAL, who have previously contracted with BUEN DEAL access to its Platform, directly providing all the information on the Goods that are displayed through said Platform (price, characteristics, and in general all its objective conditions). These, in their exclusive capacity as producer, supplier and / or vendor, are directly in charge of complying with all the objective characteristics of the product and / or service published on the Platform.
"Order" refers to the request of the Seller's Users through the Platform of the Goods offered by the Seller.
"Website" refers to the website buendeal.com or its respective variants.
"User" and "Client" refers to all natural or legal persons who access and / or place Orders through the BUEN DEAL website.
"Platform" refers to our Web-based Platform, through which we facilitate the process of placing Orders between Sellers and Users.
"Payment Gateway" refers to a payment facility offered by BUEN DEAL through its authorized Management Bank in the Republic of Panama, which will allow online collection and payment management of the goods offered by the Seller.
If any of these words defined in the plural are used, they will have the same meaning as that indicated herein.

The availability of the Services and Products are the responsibility of each Seller. Likewise, it is the Seller's authority to define who may or may not use the Services or purchase its products. The latter, in reference to the use of the Service or the acquisition of its products by people who do not have that capacity; for example, but not limited to, minors without authorization from their parent or guardian.
To register a company as a Seller, it must have sufficient capacity to contract on behalf of the entity, as well as to bind it according to these Terms and Conditions provided herein.
Sellers are responsible for publishing the content in their digital stores. Said action makes them directly responsible for the goods they offer and compliance with the regulations and permits applicable to them under Panamanian law. The latter applies to, but is not limited to, for example, the sale of alcoholic beverages and / or tobacco, among others, which the Seller states in the event that it is authorized to sell and sell this type of product. BUEN DEAL is limited to making available to the Sellers access to the Platform to facilitate the sale of their products through the Platform and the administration of the Orders placed by the Users of this but is not responsible for the content entered by the Sellers , nor the use that Sellers give to the Platform.
The content of the Platform, including, but not limited to the texts, graphics, images, logos, icons, software and any other material, -which hereinafter will be referred to as the "Material", is protected under the applicable laws of industrial property and intellectual property. All Material is the property of BUEN DEAL or its suppliers. It is prohibited to modify, copy, reuse, extract, exploit, reproduce, communicate to the public, make second or subsequent publications, upload or download files, send by mail, transmit, use, process or distribute in any way all or part of the contents included in the Platform. Unauthorized use of the Material may constitute a violation of copyright laws, industrial property laws or other laws. No Seller or Users thereof may sell or modify the Material in any way, or perform or publicly advertise the Material, or distribute it for commercial purposes. Any unauthorized use will be presumed as improper and may be sanctioned by law.
The BUEN DEAL logo, and any other trademarks used on the Platform are trademarks of BUEN DEAL and / or its suppliers. Other graphics, logos, page headers, button icons, scripts, and service names are trademarks or trade dress of BUEN DEAL. The trademarks and commercial images of BUEN DEAL may not be used in relation to any product or service that is not of BUEN DEAL, if applicable, in any way that may cause confusion among the Sellers and / or Users of these or that rejects or discredits BUEN DEAL. Any of the trademarks that do not belong to BUEN DEAL that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by BUEN DEAL. All content and compilation of these on the site, including, without limitation, on texts, graphics, logos, designs, photographs, icons, images, data compilations and software, is the property of their respective owners, their licensors or their suppliers of products and is protected by Panamanian and international copyright laws. The main purpose of the Platform is the connection between Sellers and Users so that, through the Platform, the Users can place Orders with the Sellers. The Seller receives the order directly and is responsible for informing the User about its availability or not.
Through the Platform, all the necessary tools for Users to place an Order are centralized and granted to Sellers.
The Seller is responsible for confirming the receipt of the order requested by the User and delivering the order in accordance with the contracted specifications.
To use the Platform, Sellers must create a user account (the "Account") where certain information will be requested such as: name, email, company name, tax identification, and data to process online payments related to the Seller's record (the "Data"). The Sellers guarantee and respond, in any case, to the veracity, accuracy, validity, authenticity and updating of their Data. In no case, is BUEN DEAL responsible for the accuracy of the Sellers' Data. In the event of supplying or suspecting that the information is false, inaccurate, outdated or incomplete, we are hereby authorized and acknowledged and accepted by the Seller, to suspend or cancel your account, as well as deny you the present or future use of the Service. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer.
To access their Account, the Seller must enter their email and a password which they must always keep confidential. If the Seller forgets their password, they can reset it by clicking "I forgot my password." You are solely responsible for any activity related to your account. If you suspect any unauthorized use of your account, please immediately notify our customer service department at support@buendeal.com. The Account is unique and non-transferable. If the breach of the above provisions is detected, BUEN DEAL reserves the right to cancel, suspend or disable the accounts, without prejudice to other legal measures that it may take.
BUEN DEAL cannot guarantee the identity of the Sellers, nor of its Users. The Seller is responsible for all transactions carried out in his Account, and must notify BUEN DEAL immediately, reliably, of any unauthorized use of it, as well as any theft, disclosure or loss of his access data to the Platform. BUEN DEAL ensures the protection of the Sellers’ data. However, it will not be responsible for the fraudulent use that third parties may make of the Seller's Account, including improper uses of their data associated with online payments for the service of using the Platform.
BUEN DEAL reserves the right to reject any application for registration or to cancel a previously accepted account, without being obliged to communicate or state the reasons for their decision and without generating any right to compensation or compensation.
The User understands and accepts that BUEN DEAL does not produce, provide, sell, sell or be a distributor agent, nor in general, any type of marketer of the Goods displayed by the Seller; Therefore, the sale and purchase relationship is structured directly and exclusively between the User and the Seller. Likewise, the User acknowledges that he is solely responsible for the correct consignment of the delivery and collection addresses of the Orders, exempting BUEN DEAL from liability for any error or negligence. The User will be able to see the different options available without having to enter any personal or other data. However, in order to finalize the Order, the User must select the place of receipt of the Goods by selecting the option of picking up at the store or home delivery. In both cases, the User must enter his name and a valid phone number. For home delivery, the User must enter the delivery address.
The User must enter the store portal on the Platform and choose the goods that he wishes to acquire. Once selected, the characteristics, conditions and total value of the Order are made available to the User, according to the information provided by the Seller. The User must validate the Order and select the payment method chosen through the means of payment available in BUEN DEAL for each Seller, as indicated in section 11 of these Terms and Conditions.
Once the payment method has been selected, the User must confirm the Order.
It is important to clarify that every User of the Seller agrees to pay the price of the Order from the moment they receive the Order confirmation communication as indicated later in these Terms and Conditions. After receiving such communication, the User may only refrain from making the payment if the Order is canceled correctly, as provided in these Terms and Conditions.
When the Seller receives the Order, he must automatically and directly communicate with the User in the order status section of the Platform, where he must confirm or reject the requested service, in case of rejecting the Order, the Seller does not have the Obligation to notify the reasons for rejection.
BUEN DEAL is not responsible for complaints or problematic situations that are configured due to delays, incomplete or wrong orders, etc. between Users and Sellers unless these are directly attributable to technical failures of the Platform. The latter excludes failures in the internet service provided by third parties that are direct providers of both the User and the Seller. The User may raise any complaint related to his order so that BUEN DEAL carries out a quality control regarding the attention provided by the Sellers.
Delivery of the Order is the sole responsibility of the Seller. The User understands and accepts that BUEN DEAL will not be liable to the User for the failure to deliver the Order or in the event that it is altered or damaged - since it is the Seller who is responsible for this service.
The price of the Goods will be presented on the Platform, according to the information entered by the Seller, before the transaction is accepted by the User. The Seller agrees to show, and the user agrees to pay, the taxes that, from time to time, are determined under Panamanian legislation.
The payment methods for each Order depend on each Seller, so the User can verify this information at the time of payment of the Order. BUEN DEAL makes available to the Seller, if he decides to purchase it, an online payment gateway to be used only for the payment of legal goods related to the natural course of the Seller's business and acquired by the User
1. Online Payment: The User may pay the price of the Order by, for example, credit or debit card.
When the User chooses to make the payment online: (i) must charge a credit card, debit card or electronic means of payment to pay the amount of the Order; these data are not stored by BUEN DEAL; or (ii) you must select a means of payment offered by the Seller.
The User must take particular care in providing personal data, which must be complete and true at the time of placing the Order. Likewise, when entering the data, the User guarantees that (i) the data provided by their electronic payment method are their property and they have sufficient funds to make the payment, when this is the preferred method; (ii) your identity corresponds to the information contained in the official and original identification granted by the national authorities.
The amount will be discounted when placing the Order by the User when using the payment gateway. If the Order is paid through the payment gateway provided on the Platform and it is subsequently canceled by the Seller, the Seller must notify BUEN DEAL to process the return through its managing Bank as soon as possible. However, the refund depends on the times stipulated in the policies of the issuer of each electronic payment method (for example, the card), on which BUEN DEAL has no responsibility or ability to modify the times that these returns require. , resulting sufficient means of proof of the diligent act of BUEN DEAL and therefore, exonerating it of any responsibility for these returns, the accreditation through payment processing documentation, of the request for the return of the sums for BUEN DEAL to the companies payment processing and card issuing companies, as applicable.
If the aforementioned returns cannot be executed due to factors associated with the issuers of electronic means of payment, the refund of the amount must be agreed directly between the User and the Seller.
Online transactions may be rejected, when the validation and acceptance of the payment is not confirmed or accepted by the Managing Bank of the BUEN DEAL Payment Gateway or when the User's bank or the means of payment so determines. BUEN DEAL is not responsible for the internal authorization procedures provided by the bank / financial entity that issues the payment instruments, nor for the permits required by means of payment to make purchases online.
In the details of the transaction, the User will be able to verify the complete payment information. If the User paid the order with Online Payment and the payment was confirmed, he should not make another payment for the Order, unless he had made modifications to the Order as indicated in these Terms and Conditions.
In any case in which the use of a means of payment generates bank commissions, commissions of the payment processing companies, commissions of the issuers of payment means or of another type and its corresponding tax, the Seller accepts that this amount runs on its own and will be discounted by BUEN DEAL at the moment in which the latter deposits the amounts collected to the Seller.
The User has a term of three (3) business days immediately following the delivery of the product in order to request the return or exchange of the product. For the purposes of this process, BUEN DEAL will retain the amounts from each purchase until the disputes and / or claims period ends in order to comply with the process detailed below.
In the event that the User requires to request the return or exchange of the product, he must notify Buen Deal through the tools enabled on the Platform. Then, Buen Deal will notify the Merchant of said request. It is essential and mandatory to have the product and the complete box, as it was delivered. Otherwise, the return or exchange of the product will not proceed. In the same way, BUEN DEAL, will return the money as the last option, after having exhausted the communication channels between the Seller and the User for the change of product, or if the Seller instructs BUEN DEAL that in some specific case it is not It is possible to exchange the product and you must proceed with the refund of the money.
BUEN DEAL is in no way responsible for changing and / or replacing any product whose order has been generated through the Platform since both the User and the Seller acknowledge and accept that BUEN DEAL is not responsible for the products, but rather as a measure of Added value, BUEN DEAL offers to refund the money withheld during the period of disputes and / or claims.
General conditions for Returns, Replacement and / or money back:
BUEN DEAL has an advertising service through which it is made available to Sellers and Users through banners, emails and / or other means. The links or links that lead to other websites owned by third parties are provided for your convenience only. BUEN DEAL does not endorse, recommend or assume any responsibility for the content of these.
The Seller or User can request not to receive any more emails or other notifications related to advertising by requesting in writing the wish of it by sending an email to the address support@buendeal.com.
The promotions or discounts of the goods that are implemented by the Sellers through the Platform will be subject to the rules and conditions that at each opportunity are established in advance by the Sellers. Under no circumstances does this imply that BUEN DEAL is related to them. In the event that any of the aforementioned activities are carried out, the terms and conditions of said activities will be defined solely by the Sellers and it will be their responsibility to inform the Users in due form on the Platform or other means.
Sellers and Users accept that BUEN DEAL may enter into commercial agreements with third parties for the purposes of making promotional communications, including, but not limited to, the display of advertising banners on digital menus and the sending of direct communications by email or other means. digital, among others.
BUEN DEAL only makes available to the Sellers and Users of this a technological platform the ability to communicate via the Internet to the Users and Sellers and thus buy and sell, respectively, the products and / or services offered through this tool by the Sellers. BUEN DEAL is not the provider or owner of the products and / or services offered by the Seller, nor does it have possession of them or offer them for sale. The Seller is solely responsible for the existence, quality, quantity, condition, integrity, innocuousness or legitimacy of the products and / or services. The User knows and accepts that when placing Orders with Sellers, they do so at their own risk.
Sellers and Users may not use the Platform for the purpose of transmitting, distributing, storing or destroying material (i) in violation of any applicable law or regulation, (ii) in a way that infringes the laws on copyright, industrial property , trade secrets or any other intellectual property rights of third parties or in a way that violates the privacy, publicity or other personal rights of third parties, or (iii) in a way that is defamatory, obscene, threatening or abusive. This without prejudice to particular rules on the matter that are mandatory in each of the legal systems corresponding to the territories in which BUEN DEAL will provide its services.

Sellers and Users acknowledge and accept that BUEN DEAL at their sole discretion and without prior notification, reserves the right to suspend or cancel the Seller or User's registration, and therefore, deny access to this Platform in the event of any Breach of these Terms and Conditions by the Sellers and / or their Users or due to the impossibility of verifying or authenticating any information that they have presented in the registry to access the Platform. BUEN DEAL does not guarantee that the Platform will operate error-free or that its server is free of computer viruses or other harmful mechanisms. If the use of the Platform or the material results in the need to request repair or maintenance service to your equipment or information or to replace your equipment or information, BUEN DEAL will not be responsible for the costs that this implies.
The Platform and the material are made available to the Sellers and Users of the same in the state in which they are. No guarantee is given regarding the accuracy, reliability or timeliness of the material, services, texts, software, graphics and links.
In no case, BUEN DEAL, its suppliers or any person mentioned in the Platform, will be responsible for damages of any nature, resulting from the use or the inability to use them.
By visiting the Platform, Sellers and Users accept that the laws of Panama, regardless of the principles of conflict of laws, will govern these Terms and Conditions, as well as any controversy, of any kind, that may arise between the Seller or the User and BUEN DEAL.
We reserve the right to make changes to our Platform, policies, and these Terms and Conditions at any time. In the event that any of these conditions are invalid, null or for any unenforceable reason, such conditions will be considered severable and will not affect the validity and applicability of any of the other conditions.
Sellers and their Users expressly acknowledge and accept that: (a) their use of the Service provided through the Platform is at their own risk and expense. The Service is provided "as is" without warranties of any kind or additional to those expressly included in the description of the Product or Service; (b) no guarantee is given in relation to errors and failures that occur on the Platform; (c) BUEN DEAL does not assume any obligation or responsibility for any error or omission in the provision of the Service, the use of the Platform or in the content of the Website. BUEN DEAL offers and agrees only the contractual conditions or stipulations that are expressly individually consigned.
The Sellers and their Users undertake to keep BUEN DEAL, its subsidiaries, affiliates, officials, agents, partners and employees free from any loss, liability, claim, action, demand, compensation, damage or harm related to the Service offered, mainly in the cases in which the Sellers or the Users of this violate the Terms and Conditions or the fact derives from the breach of the Sellers or their Users of their obligations under this document. As a consequence, BUEN DEAL will have the right to be reimbursed by the Sellers or its Users in the event of any loss or expense that it suffers or has to do, including those related to its defense, such as attorney's fees, posting of bonds, or any other, in cases where the court is considered not responsible for the causes that have caused such losses or deterioration.
FOR ALL INFORMATION IN THE TERMS AND CONDITIONS, USE OF THE PLATFORM, EXPOSURE OF CONTENT, TERMS OF COMMERCIALIZATION, PRIVACY AND RESPONSIBILITIES WILL BE GOVERNED BY THE LAWS OF THE REPUBLIC OF PANAMA. BUEN DEAL HAS THE RIGHT TO RESTRICT ACCESS TO THOSE WHO BREACH WITH WHAT IS DESCRIBED HEREIN.
